Two documents produced in the 1990s discuss its refitment into a declared monument in a Municipal level, and the other in a State level, that will conduct our study to it. The building ,where lived the wealthy family Guimarães Reis, was a space of one of the most famous national crimes and , in addition to permanent building in São Paulo's urban landscape, because of that, it had a period to conduct the study and the process to be a declared monument had a curious approach. The space has provoked a debate by the agents of the two refitment comissions that brought us conceptions from architects, historians, lawyers, journalists and even the public opinion that came up. If the Municipal instance endorses the building as Historical monument of São Paulo, on the other hand, the state instance does not give it the same acknowledgment. In addition, the State of São Paulo also decreed that due to the irrelevance of the edification, the reopening of studies for a debate on the building is interposed. With this dilemma in hand, the study aims to understand issues of actions and impasses of monumental preservation, caused by differences of official protection, as understanding of the Paulistas monumental practices through this edification. Therefore, it propose a historical analysis about the discourses contained in the studies and refitment processes about the Castelinho of Apa Street, which resulted in different positions about it.
