- ItemAcesso aberto (Open Access)Desprecarização do trabalho no sus: um estudo sobre o plano de cargos, carreiras e salários do sus, na perspectiva dos trabalhadores e representantes sindicais no município de Guarulhos, Região Metropolitana de São Paulo(Universidade Federal de São Paulo (UNIFESP), 2014-11-24) Rizzo, Tamiris Pereira [UNIFESP]; Lacaz, Francisco Antonio de Castro Lacaz [UNIFESP]; Universidade Federal de São Paulo (UNIFESP)This qualitative study aimed at apprehending, from the perspective of the municipal workers at SUS Guarulhos and union representation, the role of the Post, Career and Salary Plan (PCCS) as an instrument of improvement of work relations at SUS; as well as identifying the actions of these actors in the construction of this proposal. Regarding the method, the document analysis was held from the minutes of the Health City Council meetings and union bulletins, as well as the analysis of interviews with managers and union representatives beyond the focal group of workers of the health network, using the content analysis tool. With regard to the results, it was observed that the PCCS has strong administrative and technical bias and suffered budget constraints that have compromised their application according to law. The plan represented an important, though limited, tool to promote working relations that through an open tender would ensure labor and social rights. Its main limitation is the fact that its scope has met just 68% of workers in the sector, and that its implementation and possible expansion followed coexisting with the municipal administration of direct promotion of managed services contracts and human resources contracting through public non-state partnerships. The CLT contract regime also limits the stability of formal workers. There was no role of workers and their unions in the construction of the proposal. As a conclusion, one can say that improvement of labor relations at SUS goes beyond the limits of the PCCS and the observation of bonds that ensure labor and social rights. One should also consider confronting the obstacles brought by the State Administrative Reform in the health sector in pursuit of fulfillment of the main paradigms of Health Reform at the macro level structure and at the level of labor relations with the loss of the meaning of work, as shown by the theoretical framework adopted in this study.

TCE-SP ? performance with regard to the legality, efficiency, advertising and formal dimension of accountability, for this considering the procedural review of the decisions of representations filed in 2013 and 2014 and judged until 28/01/15. The purpose of this study was, in first, analyze the complaints made to the São Paulo?s Court of Auditors but, due to the lack of disclosure on the website of the institution, we proceed to the analysis solely of representations. To do this, first we position the audit courts in the democratic rule of law, assessing their independence and autonomy. Then we follow with the explanation of its main features and prerogatives, as well as the review of the nature of its decisions and its process. We pass, in sequence, to talk about control in the broad sense for the purpose of understand how it is exploited in Brazil. As the analysis of present decisions based on indicators related to the constitutional principles of efficiency, legality and publicity, as well as formal dimension of accountability, we treat these issues to finally introduce the channels for bringing complaints and representations existing in the Court of Auditors of the State of São Paulo and performed an analysis of the decisions itself, based on indicators developed for this purpose. Regarding the methodology, as to the means the research was bibliographical and documentary and, as to the purposes, descriptive. Decisions, judgments and rulings of the TCE-SP were collected from the website of the institution and the data generated from it were analyzed qualitatively, based on the constitutional principles of legality, transparency and efficiency, as well as formal dimension of accountability. It was found, finally, that the indicators are present only partially in the decisions of TCE-SP, requiring improvements in information provided. The study also suggests actions for constitutional principles and accountability are respected, so that the TCE-SP fulfill its role of negative feedback mechanism and thus enable an effective social control.
